Terms & Conditions
These Terms & Conditions govern your use of the website xmuscle.co.uk ("the Site") and your purchase of products from us. Please read them carefully before placing an order. By using the Site or placing an order, you agree to be bound by these terms.
1. Who we are
XMuscle is a trading name of Mando Systems Ltd, a company registered in England & Wales under Company No. 17168657. Our registered office is 10 Pilgrims Walk, Worthing, BN13 1RJ. In these terms, "we", "us" and "our" refer to Mando Systems Ltd trading as XMuscle.

2. Eligibility
You must be at least 18 years of age to purchase food supplements from the Site. By placing an order, you confirm that you are 18 or over and that you are legally capable of entering into a binding contract. We may cancel any order where we reasonably believe this requirement has not been met.
3. Products & health disclaimer
The products we sell are food supplements intended to complement a healthy lifestyle. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease or medical condition. No medicinal claims are made about any product on the Site.
Food supplements should not be used as a substitute for a varied and balanced diet and a healthy lifestyle. Please note the following:
- Always read the product label and follow the recommended usage instructions. Do not exceed the stated recommended daily dose.
- If you are pregnant, breastfeeding, taking any medication, or have a medical condition, please consult your GP or a qualified healthcare professional before using any supplement.
- Discontinue use and seek medical advice if you experience any adverse reaction.
- Keep all products out of the sight and reach of children.
- Store products as directed on the label, typically in a cool, dry place away from direct sunlight.
We take care to describe our products accurately, but images and descriptions are provided for guidance only. Product formulations, labelling and packaging may change from time to time.
4. Pricing & VAT
All prices shown on the Site are in pounds sterling (GBP). Where applicable, prices are inclusive of VAT at the prevailing rate. Delivery charges, where they apply, are shown separately at checkout before you confirm your order.
We try to ensure that all prices are accurate, but errors may occasionally occur. If we discover an error in the price of goods you have ordered, we will contact you as soon as possible to let you know and give you the option of continuing the purchase at the correct price or cancelling the order. If we are unable to reach you, we will treat the order as cancelled and refund any payment already made.
5. Orders & acceptance
When you place an order, you are making an offer to purchase the products in your basket. We will send you an email acknowledging receipt of your order. This acknowledgement does not mean your order has been accepted.
A binding contract between you and us is only formed when we send you an email confirming that your order has been dispatched. We reserve the right to decline or cancel any order before dispatch, for example where a product is out of stock, where there has been a pricing or description error, or where we are unable to obtain authorisation for your payment. If we decline or cancel your order after payment has been taken, we will provide a full refund.
6. Payment
All payments are handled securely via PayPal. At checkout you can pay using your PayPal balance, a credit or debit card, Apple Pay, Google Pay, or Pay by Bank through the PayPal interface. We do not store your full card details on our own systems.
Payment is taken at the time you place your order, through PayPal. This does not affect the point at which a binding contract is formed (see section 5); if for any reason we do not accept or subsequently cancel your order before dispatch, we will refund any payment already taken in full. If payment is declined or cannot be processed, your order will not be dispatched.
7. Subscriptions
We may offer certain products on a recurring subscription basis, managed through PayPal. If you choose a subscription, you authorise us to take recurring payments via PayPal at the intervals and price shown at the time you subscribe, until the subscription is cancelled.
You can cancel a subscription at any time. To cancel, contact us at hello@xmuscle.co.uk, or manage your recurring payment directly through your PayPal account. Cancellation stops future payments and deliveries; any order already dispatched will be fulfilled and charged as normal.
8. Delivery
We deliver to mainland UK addresses. Orders are typically dispatched within around 1 working day, and delivery usually takes a further 2–4 working days after dispatch. Delivery times are estimates and are not guaranteed.
Delivery is free on orders over £49.99. For orders of £49.99 or less, a flat delivery charge of £4.99 applies. The applicable charge is shown at checkout before you confirm your order.
9. Cancellation & returns
Under the Consumer Contracts Regulations 2013, you generally have the right to cancel your order and return the goods for a refund within 14 days from the day after you receive your goods, without giving a reason.
However, for hygiene and safety reasons, food supplements cannot be returned once any seal is broken or the product has been opened, unless the product is faulty. Unopened products with intact seals may be returned within the cancellation period.
Faulty, damaged or not-as-described goods can always be returned and are covered by your statutory rights (see below), regardless of whether the seal has been broken.
Where you validly cancel and are entitled to a refund, we will process it within 14 days of receiving the goods back (or of your providing evidence that you have returned them), in accordance with the Regulations. 10. Your consumer rights
Nothing in these terms affects your statutory rights. Under the Consumer Rights Act 2015, the goods we supply must be as described, of satisfactory quality and fit for purpose. If a product is faulty or not as described, you are entitled to a repair, replacement or refund in accordance with your legal rights.

11. Nutrition & health claims
Any nutrition and health claims made on the Site are intended to comply with applicable UK law governing the labelling and marketing of food supplements. We do not make medicinal claims, and no product is presented as being able to prevent, treat or cure any disease. Statements about ingredients are provided for information only and should be read alongside the product label.
If you are ever unsure whether a product is suitable for you, please consult your GP or a qualified healthcare professional before use.
12. Intellectual property
All content on the Site, including text, graphics, logos, product images, page layouts and the "XMuscle" name and branding, is owned by or licensed to Mando Systems Ltd and is protected by copyright and other intellectual property laws. You may not copy, reproduce, republish, distribute or otherwise use any part of the Site for commercial purposes without our prior written permission.
13. Limitation of liability
We take care to provide accurate information and quality products, but to the fullest extent permitted by law:
- We are not liable for any loss or damage that is not a foreseeable result of our breach of these terms.
- We are not liable for business losses. Our products are supplied for personal, domestic use only, and we have no liability for any loss of profit, loss of business, business interruption or loss of business opportunity.
Nothing in these terms limits or excludes our liability where it would be unlawful to do so, including any liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any breach of your statutory rights as a consumer.
14. Events beyond our control
We will not be liable for any delay in, or failure to perform, our obligations where that delay or failure is caused by events beyond our reasonable control, including but not limited to supply failures, courier or postal delays, strikes, adverse weather, fire, flood, power failures, acts of government or public authorities, or telecommunications and network failures. If such an event occurs, we will contact you as soon as reasonably possible and take steps to minimise the effect of the delay.
15. Data protection
We process personal data in accordance with the UK GDPR and the Data Protection Act 2018. Mando Systems Ltd is the data controller for personal data collected through the Site. The supervisory authority for data protection in the UK is the Information Commissioner's Office (ICO), ico.org.uk.

16. Governing law & jurisdiction
These Terms & Conditions are governed by the laws of England & Wales. Any disputes arising out of or in connection with them will be subject to the non-exclusive jurisdiction of the courts of England & Wales. This does not affect any mandatory consumer protection rights available to you under the law of the part of the UK in which you live.
